MAHJMATE — Terms and Conditions of Use

Notice: NOTICE TO USERS: These Terms constitute a legally binding agreement between you and MahjMate ("the League"). By creating an account, paying a season fee, or using any part of this platform, you agree to be bound by these Terms in full. If you do not agree, do not register or use this platform.

1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of the MahjMate Platform, including its website, web application, scheduling tools, leaderboard, score-tracking features, player directory, and any related services (collectively, the "Platform").

By registering for an account, paying a season fee, or using any feature of the Platform, you confirm that: you are at least 18 years of age; you have read, understood, and agree to these Terms; you have the legal capacity to enter into a binding agreement; and you will comply with all applicable local, state, and federal laws in connection with your use of the Platform.

2. Description of the Service

The Platform is a private, membership-based league management service for recreational mahjong play. It provides tools for game scheduling and coordination, score entry and leaderboard tracking, a player directory, personal game history, calendar integration, and administrative management by league operators. The Platform is intended solely for use by registered members. Access is not transferable and may not be shared with third parties.

3. Registration, Accounts, and Eligibility

3.1 Account Creation. To use the Platform you must create an account by providing accurate, current, and complete information including your full name, email address, phone number, and a skill rating. You agree to keep this information up to date.

3.2 Email Verification. We may require you to verify your email address before your account is fully activated. Failure to verify may result in limited access or account suspension.

3.3 Account Security. You are solely responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. The League is not liable for any loss or damage resulting from your failure to protect your account credentials.

3.4 One Account Per Person. Each individual may hold only one active account. Creating duplicate or fraudulent accounts is prohibited and will result in immediate revocation of all associated accounts.

3.5 Account Revocation. The League reserves the right to suspend or permanently revoke your account at any time, with or without notice, for any violation of these Terms, conduct deemed harmful to the community, or for any other reason at the League's sole discretion.

4. Season Fees and Payments

4.1 Season Fee. Participation in a League season requires payment of a season fee as set by the League for that season. Fees are displayed at the time of registration and are subject to change between seasons.

4.2 Payment Processing. Season fees are collected via Stripe, a third-party payment processor. By submitting payment information, you also agree to Stripe's terms of service and privacy policy. The League does not store your full payment card details.

4.3 Coupon Codes. The League may, at its discretion, issue coupon codes that reduce or waive the season fee. Coupons are non-transferable, may not be combined unless expressly stated, and may be revoked if misused or obtained fraudulently.

4.4 Refund Policy. Season fees are generally non-refundable once a season has begun. Refund requests prior to the season start date may be considered at the League's sole discretion.

4.5 Failed or Disputed Payments. If your payment fails or is disputed, your account may be suspended until the matter is resolved. Initiating a chargeback without first contacting the League may result in permanent account revocation.

5. Member Conduct and Community Standards

5.1 General Standards. MahjMate is a recreational community. All members are expected to treat fellow players with courtesy and respect, both on the Platform and at in-person games.

5.2 Prohibited Conduct. You agree not to: harass, threaten, defame, or intimidate any other member; use the player directory, email addresses, or phone numbers obtained through the Platform for any commercial, promotional, or non-League purpose; misrepresent your skill level; deliberately submit inaccurate or falsified game scores; attempt to manipulate the leaderboard, scoring system, or waitlist; share your account credentials; scrape or systematically extract data from the Platform; or use the Platform for any unlawful purpose.

5.3 Score Integrity. Scores are entered by the game host and are subject to a 48-hour administrative review window. Scores are considered final after that window closes unless disputed through the proper process.

5.4 Late Cancellations. Cancelling your spot in a game within 24 hours of its scheduled start time may result in a point penalty applied to your cumulative leaderboard score. Repeated late cancellations may result in account suspension.

6. Player Directory and Privacy

6.1 Directory Participation. Your profile is visible in the player directory by default. You may opt out at any time via your account settings.

6.2 Contact Information. Your email address and phone number are private by default. You may choose to make them visible to other directory members.

6.3 Directory Use Agreement. By accessing the player directory, you agree to the separate Directory Use Agreement, which governs permissible uses of member contact information.

6.4 Data Collection. By registering, you consent to the collection and use of your name, email, phone number, skill rating, game history, scores, and payment records as necessary to operate the Platform. We do not sell your personal data to third parties.

7. Calendar Integration and Notifications

The Platform provides optional calendar integration features. By providing your contact information and selecting notification preferences, you consent to receiving transactional communications related to your account and games.

8. Intellectual Property

The Platform, including its software, design, graphics, and branding, is the property of MahjMate. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform solely as a registered member.

9. Disclaimers and Limitation of Liability

9.1 The Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

9.2 To the fullest extent permitted by applicable law, MahjMate and its administrators, officers, agents, and volunteers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Platform. The League's total liability shall not exceed the amount you paid in season fees in the twelve (12) months preceding the claim.

9.3 Third-Party Services. The Platform integrates with third-party services including Stripe and calendar applications. The League is not responsible for the availability or conduct of these services.

10. In-Person Games and Personal Safety

The Platform facilitates the scheduling of in-person games. The League does not vet or background-check its members. By joining games arranged through the Platform, you acknowledge that you are meeting other individuals in person and assume all associated risks.

11. Modifications to the Platform and These Terms

The League reserves the right to modify, suspend, or discontinue any part of the Platform at any time. These Terms may be updated from time to time. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms.

12. Termination

You may close your account at any time by contacting a League administrator. Closing your account does not entitle you to a refund. The League may terminate your account at any time for violation of these Terms.

13. Governing Law

These Terms shall be governed by the laws of the State of Arkansas, without regard to its conflict of law principles. You consent to the exclusive jurisdiction of the courts located in Pulaski County, Arkansas.

14. Dispute Resolution

Before initiating any formal legal proceeding, you agree to first contact the League in writing at [email protected] and attempt to resolve the dispute informally. If informal resolution fails, disputes shall be resolved by binding arbitration rather than in court.

YOU UNDERSTAND THAT BY AGREEING TO THESE TERMS, YOU ARE WAIVING YOUR RIGHT TO A JURY TRIAL AND YOUR ABILITY TO PARTICIPATE IN A CLASS ACTION.

15. General Provisions

These Terms, together with the Directory Use Agreement, constitute the entire agreement between you and the League with respect to the Platform. If any provision is found unenforceable, the remaining provisions continue in full force and effect.
